WHAT SHOULD I DO IF MY EX WON’T FOLLOW OUR CUSTODY AGREEMENT?
You survived the painful process of divorce or a determination of custody, and you thought it would be smooth sailing from there, simply waiting for your youngest to emancipate at eighteen. This is not the case for every family!
Many parents struggle with their child’s other parent following the custody agreement they agreed upon. It can be frustrating for you, and stressful for your children. What remedies are available to you? How should you handle it? Michelle Hopkins offers insight below.
Comply
Do everything that you are supposed to do. Follow the agreement exactly. This helps strengthen your side by showing your willingness to comply, should you need to litigate.
Communicate
Be sure to communicate with your ex in writing whenever discussing something important or noteworthy, especially regarding compliance. Email is the best form, because each email clearly lists dates, whereas text messages only show the date at the beginning of the conversation, and most text conversations cannot be captured in one screen shot with the date.
Document
Keep a journal, listing dates, times, and details, of each time that your ex did not comply with the custody agreement. It can help to site the page and section that they violated. If this violation impacted your children in a specific way, you could include that in the notes as well.
Consult
Schedule a consultation with a lawyer who practices in your jurisdiction to determine if you have proper cause to reopen your custody case, and to understand all your options and what potential outcomes would be possible if you litigated.
