Can I Stop My Divorce In Virginia?
In some cases, one party is not agreement with their spouse’s request to divorce. It may be difficult to receive such a request when you want to remain married. If you want to remain married, what are your options? Read the insight of experienced divorce lawyer Michelle Hopkins’s on this difficult topic below.
Would My Opinion Be Considered?
Unfortunately, no. Your spouse does not need your permission to divorce, and they do not need your opinion to be in support of the divorce either if they choose to proceed with petitioning for one.
What Happens If I Don’t Cooperate With The Divorce Process?
If you chose not to cooperate with the divorce process, at best, you could delay the proceedings. You would not be able to completely stop the divorce from happening. Even if you never answered any correspondence, your spouse would still be able to proceed with completing the divorce process. Even if you intentionally missed your Court dates, your spouse could still petition the Court for a divorce. After a period of non-responsiveness, a Judge would grant your spouse a divorce.
Could I Petition The Court To Remain Married?
No, you could not petition the Court to remain married. A judge would not deny your spouse’s request for a divorce because you wanted to remain married.
Do I Have Any Options?
If you are invested in repairing your marriage, communicate that to your spouse. You may consider asking your spouse to attend couple’s counseling with you. They do have the option to decline your request.
